Judge's dismissal of harassment charge goes viral

(AP) ? A central Pennsylvania judge who came under fire for throwing out a harassment case against a Muslim man accused of accosting an atheist activist who dressed as a zombie version of the Prophet Mohammed in a Halloween parade said Tuesday he would not do anything differently.

Mechanicsburg District Judge Mark Martin said many of the hundreds of calls he has received in the week or so since the alleged victim posted an audiotape of the December trial online are acting on the mistaken assumption that he is Muslim.

The uproar led the court system on Tuesday to temporarily move Martin as a security precaution to the county courthouse in Carlisle, about 10 miles from his regular courthouse in the Harrisburg suburbs.

On the audio, Martin appears to tell the purported victim, Ernest Perce V, that he is a Muslim, and that Perce's actions were "very, very, very offensive" to the faith. Martin said Tuesday he was trying to make the point that people who are Muslim would be offended, an opinion based on the Army reservist lieutenant colonel's two tours of duty in Iraq and one in Afghanistan.

Most of the complaints he's fielded suggest he went easy on Talaag Elbayomy as a fellow Muslim, and argue he should have recused himself, Martin said.

"In actuality, I'm a Christian," Martin, a Lutheran, told The Associated Press. "Does that mean I should recuse myself in all cases that involve Christians?"

Martin said he dismissed the case for lack of evidence after Elbayomy testified that the confrontation was not physical, an apparent contradiction of what he told police the day of the parade. Court records spelled his first name Talaag, an online listing had Talaat and Perce's video called him Talaaq.

Before he ruled, Martin told Perce he had misrepresented tenets of Islam, which made him "look like a doofus."

"It's unfortunate that some people use the First Amendment to deliberately provoke others," Martin said on the audiotape. "I don't think that's what our forefathers really intended."

Perce, Pennsylvania director of the group American Atheists, said he's received more than 500 death threats in recent days. He marched in the parade along with a man dressed as a zombie pope.

"When it came to the judge telling me I was way outside the bounds of freedom of speech, my immediate thought at this point was, 'Whose side are you on? You're a soldier. Whose side are you fighting for?'" Perce said Monday.

Martin said the First Amendment permitted Perce to act as he did.

"What I was trying to convey to him was, just because you can say or do something, doesn't always mean you should," Martin said.

Perce said his status as an atheist seemed to play a part in the case.

"I can't believe that in America a person gets attacked, and then they get called a doofus, ridiculed on the stand, like I'm a piece of garbage because of my lack of belief," Perce said.

Elbayomy's lawyer, R. Mark Thomas, said there was no physical or circumstantial evidence to support Perce's claim that Elboymay tried to pull off his fake beard and a sign he wore around his neck.

Both men contacted police immediately ? in Elboymay's case because he did not realize that it is not a crime to ridicule his religion's chief prophet.

"The judge dressed (Perce) down, (and) as far as I was concerned, that was the right thing to do," Thomas said. "This guy was obviously the antagonist."

Sam Stretton, a West Chester lawyer who has defended judges accused of misconduct, and who writes and speaks regularly on judicial ethics, said he advises judges to avoid discussions outside the matters in front of them.

"I always tell judges, look, decide cases, but you're under no obligation to explain in detail what's going on," he said.

Martin's discussion of religion might not be bad advice in another context, Stretton said.

"The problem is when you're saying it with a judicial robe on," he said. "But it's not the worst thing to say."

The Scottish actor, 42, has wrapped up a substance treatment program, his rep confirmed.

According to TMZ, the Bounty Hunter star checked in to the Betty Ford Center three weeks ago to deal with an escalating problem with prescription pills.

Fiction author offers public reading while 'in residence' - The Scarlet

Acclaimed fiction author ZZ Packer, regarded as one of the country?s best young novelists, will give a public reading March 8 and participate in other community activities as part of a visit to UNL.

Packer is this year?s ?Writer in Residence? for UNL?s Department of English and Creative Writing Program. Her visit is also hosted by UNL?s Office of the Senior Vice Chancellor for Academic Affairs.

The March 8 reading, which will be followed by a reception and a book signing, is scheduled for 7 p.m. at the Great Plains Art Museum. She will also offer a craft talk on ?Voice in Fiction? at 12:30 p.m., March 7 in the Dudley Bailey Library in Andrews Hall. Both events are free and open to the public.

Packer is the author of a short story collection ?Drinking Coffee Elsewhere,? which was a PEN/Faulkner finalist and a New York Times Notable Book. She is the recipient of a Guggenheim Fellowship and was recently named one of America?s Young Innovators by Smithsonian Magazine as well as one of America?s Best Young novelists by Granta Magazine.

(AP) ? Roger Simpson said he looked down the road and saw a little girl running outside her home but didn't give it another thought. Police, however, said the man witnessed a murder in progress.

Authorities say 9-year-old Savannah Hardin died after being forced to run for three hours as punishment for having lied to her grandmother about eating candy bars. Severely dehydrated, the girl had a seizure and died days later. Now, her grandmother and stepmother who police say meted out the punishment were taken to jail Wednesday and face murder charges.

Witnesses told deputies Savannah was told to run and not allowed to stop for three hours on Friday, an Etowah County Sheriff's Office spokeswoman said. The girl's stepmother, 27-year-old Jessica Mae Hardin, called police at 6:45 p.m., telling them Savannah was having a seizure and was unresponsive.

Simpson said he saw a little girl running at around 4 p.m., but didn't see anybody chasing or coercing her.

"I saw her running down there, that's what I told the detectives," Simpson said from his home on a hill overlooking the Hardins. "But I don't see how that would kill her."

Authorities are still trying to determine whether Savannah was forced to run by physical coercion or by verbal commands. Deputies were told the girl was made to run after lying to her grandmother, 46-year-old Joyce Hardin Garrard, about having eaten the candy, sheriff's office spokeswoman Natalie Barton said.

Savannah Hardin died Monday at Children's Hospital in Birmingham, according to a news release from the sheriff's office. The sheriff's release said an autopsy report showed the girl was extremely dehydrated and had a very low sodium level. A state pathologist ruled it a homicide.

The sheriff's office received calls from concerned citizens who witnessed the girl running. No other details were released, but an official with the local volunteer fire department said rescuers thought something seemed odd when they responded to a call about the child.

"One of the ones who were down there said he didn't feel like everything was right," said Ruby Ward, vice president of the Mountainboro Volunteer Fire Department.

Gail Denny and her husband Phil, live just up a dirt road from the home. They've known the family since they moved to the area in northeastern Alabama seven years ago.

The couple said they were used to seeing Savannah and other neighborhood children out waiting on the school bus in the morning. Gail Denny said her grandson had a crush on Savannah.

"My grandson asked her to be his girlfriend on Valentine's Day, and she said 'yes,'" she said before dissolving into tears. She left a candle and stuffed animal outside the girl's home Wednesday night, saying a prayer as she paused beside the road.

The trailer where Savannah lived was surrounded by a wooden fence, playground equipment and toys. Neighbors say they never saw children playing in the yard.

They told The Associated Press that Garrard owned a lot of property along the road and much of her family lived in homes on that property.

"It seems like a very happy extended family around here," Denny said. "There are mothers, grandmothers, kids. It sounds like a punishment that got out of hand."

Garrard and Jessica Mae Hardin are being held in the Etowah County Detention Center, each on a $500,000 cash bond.

Court records show that Robert Hardin filed for divorce in August of 2010. In his complaint, he asserted his wife was bi-polar and had alcoholic tendencies. He accused her previously of having run off with the couple's own child. In her response, Jessica denied all of Robert's allegations.

Five months after filing for divorce, the two asked a judge to dismiss their case.

Savannah Hardin was a third-grader at Carlisle Elementary School. Superintendent Alan Cosby said her desk had been turned into a makeshift memorial where her classmates could leave notes and mementos. He said counselors and social workers were made available for students.

"This is obviously a very tragic, devastating, heartbreaking situation," Cosby said. "Nothing like this has ever happened before."

Logitech M600 Touch Mouse


The Logitech M600 Touch Mouse joins several other touch-enabled computer mice, such as the Apple Magic Mouse ($69.99 direct, 3.5 stars) and Microsoft Touch Mouse ($79.95 list, 4.5 stars), which put a touch-sensitive surface directly on the mouse. Sometimes the results are good, as with the Microsoft Touch Mouse, but other times, it's a failed gimmick, as seen with the Verbatim Wireless Optical Touch Mouse ($29.99 street, 2.5 stars). Thankfully, the Logitech M600 does touch very well, by sticking with what works. The sleek yet comfortable design doesn't hurt, either.

Design and Features
The Logitech M600 Touch Mouse looks very much like a smooth wet stone pulled out of a river. Its dark grey colors and smooth rounded surface reinforce this imagery, but also make for a fairly comfortable mouse. On the front half of the device, where a traditional mouse has left and right buttons, the entire top surface of the mouse is touch-sensitive. This allows you to scroll and swipe right on the surface of the mouse. You also have regular clicking capability, which is smooth and quiet.

The M600 measures 1.1 by 2.52 by 4.41 inches (HWD)?neither too large, as with the HP Wi-Fi Touch Mouse, or too low-profile, as with the Apple Magic Mouse. It's also lightweight, weighing only 3.84 ounces with two AA batteries. In an interesting trick, you can make the mouse lighter by removing one of the included AA cells?it will run on either one or two batteries. With one battery, it weighs only 3.04 ounces, but the estimated battery life drops from nine months to three.

The Logitech M600 Touch Mouse is a wireless optical mouse that connects via 2.4GHz signal through a USB nano-receiver small enough to plug in and leave in for daily use. With a 33-foot range (our anecdotal testing pegs it at something closer to 45 feet) you can use the mouse from across the room, so you could also incorporate it into your home theater PC setup and use it while lounging on the couch.

Plus, thanks to Logitech's Unifying Receiver technology, you can connect up to five additional wireless Logitech products through the one receiver, leaving the rest of your USB ports free. The shape of the mouse allows it to be used with either right or left hands, with the necessary adjustments available in the accompanying SetPoint software utility. Logitech also covers the M600 Touch Mouse with a 3-year limited warranty on the hardware.

Software and Performance
Perhaps the best thing that about the Logitech M600 is what it doesn't try to do. We've seen touch mice that try to provide full multitouch capability, complete with pinch to zoom and rotate, but outside of Apple's Magic Mouse and the Microsoft Touch Mouse, none of those other touch contenders have adequately pulled it off.

In my initial hands-on with the M600, I assumed that the scrolling functionality would be available horizontally as well as vertically, and found I had trouble getting it to work. Upon further investigation, there is no side-to-side scrolling. What the Logitech does instead is give you the freedom to touch anywhere on the front half of the mouse, using that surface to scroll up and down and to swipe horizontally through pictures or Web pages. This simple functionality works, and works every time, while feeling much more free than when your scrolling is constrained to a touch-sensitive strip or when various gestures are misread.

Getting the mouse set up is easy: Put in the batteries and plug in the small USB wireless adapter. The drivers load quickly, and you're good to go. Logitech's SetPoint utility can also be downloaded to provide fine-tuned control over settings and features. With this software, you can adjust the resolution (dpi) of the mouse, or swap it between right- and left-handed settings.

After several days of using the Logitech M600 Touch Mouse, it's clear that Logitech has figured out how to do touch right. By limiting the feature set, the company has removed the frustration that broader gesture controls can bring. Between the simple, reliable functionality and the slick, refined-looking design, there is very little to complain about. The Microsoft Touch Mouse will remain our best in the category with its broader feature set, but the Logitech M600 is a solid runner-up.

Folks without depression who reported feeling the most stressed also had shorter telomeres. And abnormal levels of stress hormones have been found in people with post-traumatic stress disorder, chronic fatigue syndrome and irritable bowl syndrome. Which means that many more people might have chromosomes that are shortening in short order.

Those gray hairs might betray your chronological age. But the state of your chromosomes may be a better marker for how old you effectively really are.

Yosemite's alpine chipmunks take genetic hit from climate change

ScienceDaily (Feb. 19, 2012) ? Global warming has forced alpine chipmunks in Yosemite to higher ground, prompting a startling decline in the species' genetic diversity, according to a new study by researchers at the University of California, Berkeley.

The study, appearing Feb. 19, in the advance online publication of the journal Nature Climate Change, is one of the first to show a hit to the genetic diversity of a species because of a recent climate-induced change in the animals' geographic range. What's more, the genetic erosion occurred in the relatively short span of 90 years, highlighting the rapid threat changing climate can pose to a species.

With low genetic diversity a species can be more vulnerable to the effects of inbreeding, disease and other problems that threaten species survival, the researchers said.

"Climate change is implicated as the cause of geographic shifts observed among birds, small mammals and plants, but this new work shows that, particularly for mountain species like the alpine chipmunk, such shifts can result in increasingly fragmented and genetically impoverished populations," said study lead author Emily Rubidge, who conducted the research while a Ph.D. student at UC Berkeley's Museum of Vertebrate Zoology and the Department of Environmental Science, Policy and Management. "Under continued warming, the alpine chipmunk could be on the trajectory towards becoming threatened or even extinct."

Rubidge worked with Craig Moritz, professor of integrative biology and director of the Museum of Vertebrate Zoology; James Patton, professor emeritus of integrative biology and curator of the Museum of Vertebrate Zoology; and Justin Brashares, associate professor in the Department of Environmental Science, Policy and Management.

The new findings build upon previous research that found major shifts in the range of small mammals in Yosemite National Park since the early 1900s. In 2003, biologists at UC Berkeley began an ambitious resurvey of Yosemite's birds, mammals, reptiles and amphibians, retracing the steps originally taken between 1914 and 1920 by Joseph Grinnell, founder and former director of the Museum of Vertebrate Zoology.

The Grinnell Resurvey Project, led by Moritz and museum colleagues, found that many small mammals in Yosemite moved or retracted their ranges to higher, cooler elevations over the past century, a period when the average temperature in the park increased by 3 degrees Celsius, or about 5.4 degrees Fahrenheit.

It is no surprise that the alpine chipmunk (Tamias alpinus) would be more sensitive to the temperature change, since it is a high-elevation species endemic to California's Sierra Nevada, the researchers said. In the early 1900s, Grinnell and colleagues sighted alpine chipmunks at elevations of 7,800 feet. Now, the alpine chipmunk appears to be sticking to even higher elevations, retracting its range by about 1,640 feet upslope.

To test the genetic impact from that loss of geographic range, researchers compared genetic markers from 146 modern-day alpine chipmunks with those from 88 of their historical counterparts. Samples were collected from seven paired sites throughout Yosemite.

As a control, the researchers also looked at the genetics -- both historic and modern -- of lodgepole chipmunks (Tamias speciosus), a lower elevation species that had not changed its range over the past century.

The analysis of genetic markers revealed a significant decline in "allele richness" among the recently sampled alpine chipmunk populations compared with their historic counterparts. Moreover, the researchers noted that the modern chipmunks were more genetically differentiated across sites than in the past, a sign of increased fragmentation in the alpine chipmunk population.

In comparison, there were no significant changes in genetic diversity detected among the lodgepole chipmunks, a species found at elevations from 4,900 to 9,800 feet.

"Much of what we read and hear about the effects of climate change on biodiversity is based on model projections and simulations, and these models typically involve many moving parts and lots of uncertainty," said Brashares. "Thanks to the baseline provided by Joseph Grinnell's pioneering efforts in the early 20th century, we are able to go beyond projections to document how climate is altering life in California. The research led by Emily is novel and important because it shows empirically that climate change has led to the loss of genetic diversity in a wild mammal over the last several decades."

Moritz added that this study exemplifies how patterns of change in California's ecosystems can be uncovered through analyses of fossil, historic and modern records.

"At the heart of this whole enterprise is the incredibly dense historic record and specimens we have at UC Berkeley from 100 years ago," said Moritz. "These collections allow us to conduct sophisticated analyses to better understand how ecosystems are reacting to environmental changes, and to create more detailed models of future changes."

Other study co-authors are Marisa Lim, a UC Berkeley undergraduate student in integrative biology; and Cole Burton, former UC Berkeley graduate student in environmental science, policy and management (now a research associate at the University of Alberta in Canada).

Minn. couple lost in Italy shipwreck memorialized

(AP) ? The only Americans lost in last month's Italian cruise ship disaster were remembered Saturday as a faithful couple and loving grandparents who spent their final moments as they had much of their lives: together.

A memorial Mass for Jerry and Barb Heil drew hundreds of people to the couple's longtime Minnesota church in White Bear Lake, a suburb of St. Paul. The Heils are among 15 people still listed as missing from the Costa Concordia, which rammed a reef near a Tuscan island and capsized Jan. 13.

"After a tragedy such as this, it's normal for us to feel a little empty," their son, Nathan Heil, said during a service that also featured readings and prayers by several of the Heils' grandchildren. "But things will get better with time, mom and dad would always say, and usually they were right."

Friends and family recalled the couple's strong bond to each other, their four children and 14 grandchildren, and their deep and unwavering commitment to their Catholic faith. Their son also told mourners that he was glad his parents weren't suffering and were together at the end of their lives.

Thirty-two people are believed to have perished in the cruise ship accident, including the Heils and 13 other people who have not been found. Italian authorities stopped searching the ship at the end of January due to dangerous conditions, a decision that Heil family members said was disappointing but which they accepted.

Italian prosecutors are investigating the ship's captain, Francesco Schettino, for possible criminal charges, including allegedly abandoning his ship before all passengers and crew were evacuated.

The Heils' children had said their parents embarked on their overseas trip after years spent raising their children and paying for their educations.

Photo collages of the couple ? one picture showing Jerry bobbing for apples, another with Barb roasting a hot dog at a campfire ? were strewn across the foyer of St. Pius the X, where the couple had worshiped since 1973. A handmade poster featured written memories from their grandchildren: "Grandma's cinnamon rolls," ''Grandpa's stories and pictures from his trips," ''Painting with grandpa and grandma."

Nathan Heil said his 70-year-old mother and 69-year-old father, who was retired from a longtime job with the Minnesota Department of Agriculture, had health struggles in recent years but he called them "survivors."

The Rev. John Mitchell, who was lead pastor at St. Pius the X until recently, knew the couple for six years and returned to lead the memorial Mass. He said both dedicated untold hours to the church but approached their faith in different ways: Jerry liked to study and teach faith, "and he expressed himself through intellectual understanding," while his wife used it to serve the less fortunate.

"Mom favored the underdog, and it was something I learned from her," Nathan Heil said. "Anyone having a hard time was someone she felt for especially."

Mitchell said the tragic circumstances of the Heils' death raises the age-old, difficult question: "Why did this have to happen?" He said there's no an easy answer, but that God's hand could be seen in the outpouring of love and support for the Heils' children and may have been there in the couple's last moments alive.

"Most importantly they were together ? never having left each other's side," he said.
